5 Steps for Preparing Your Lemon Law Claim

July 6, 2025

If you’ve recently purchased a vehicle that seems to spend more time in the shop than it does on the road, you might have a “lemon” on your hands.

In the United States, lemon laws offer consumers protection when a new or used vehicle doesn’t meet performance and quality standards. While the law varies from state to state, it typically requires the manufacturer or dealer to replace or refund the vehicle if it meets certain criteria. To qualify as a lemon, the vehicle must have a substantial defect that affects its safety, value, or use. On top of that, the issue must persist after multiple repair attempts within a specific period or mileage limit. Consumers must usually report the problem during the vehicle’s warranty period.

Here are five steps to help you effectively prepare your lemon law claim!

Understand Your State’s Lemon Law Requirements

Each state has its specific lemon law requirements regarding vehicle eligibility, including limits on vehicle mileage and repair attempts. For example, the California Lemon Law applies if:

  • the vehicle still has the original factory warranty. The problem needs to be discovered within the first 18 months or 18,000 miles after the purchase.
  • the vehicle has a substantial defect that isn’t caused by the owner after the purchase and that impairs the vehicle’s use, value, or safety
  • there were 4 or more repair attempts for the same issue or there were 2 or more repair attempts to fix an issue that can cause injury or death.

To determine if your vehicle qualifies under your state’s lemon law protections, consult a local attorney specializing in lemon law.

Keep Detailed Records

One of the most critical parts of a successful lemon law claim is having thorough documentation. So to build a strong case, you’ll need to maintain detailed records of all communications with the dealership or manufacturer, including repair orders, invoices, and correspondence. These documents will serve as evidence to support your claim. Also, don’t forget to keep track of the dates, times, and details of all repairs and problems you’ve experienced with the vehicle.

Allow the Manufacturer or Dealer to Repair the Vehicle

Before proceeding with a lemon law claim, the manufacturer should be given a “reasonable number” of attempts to repair the defect. The actual number of repair attempts required may vary from state to state but it typically ranges from two to four repair attempts for the same issue. Four repair attempts are typically considered sufficient in many states. But if the problem is a critical safety issue, some states may consider just one or two repair attempts as sufficient.

Consult a Lemon Law Attorney

Navigating the lemon law process can be complex, especially when dealing with manufacturers or dealerships that are unwilling to cooperate. So if you suspect your vehicle may be a lemon, don’t navigate this challenging process alone! Fight for your rights by hiring a lemon law attorney. Your attorney will evaluate your case, explain your legal rights, guide you through the process, and maximize the chances of a favorable outcome. Luckily, most lemon law attorneys offer free consultations and may work on a contingency basis, which means you don’t pay any attorney fees unless they win your case.

File Your Claim and Pursue Your Remedy

After gathering your documentation, giving the manufacturer a reasonable number of repair opportunities, and consulting a lemon law attorney, you’re ready to file your claim. Your lemon law attorney will help you file your claim directly with the manufacturer or pursue further legal action if necessary. If your vehicle meets the Lemon Law criteria, the manufacturer may offer a buyback or replacement. The buyback involves refunding the purchase price minus a mileage deduction, while a replacement provides you with a similar new vehicle.
